Payment and Refund Policy

1. Definitions

"Service" refers to any and all products, services, content, features, technologies, or functions, and all related websites, applications and services offered to you by us.

"Subscriber" means any person or entity who has agreed to these Terms of Service to use the Service.

"Payment Processor" refers to Stripe, Inc., which processes payments for the Service.

"Trial" means any free trial period of the Service offered to potential Subscribers.

"Terms" means these Terms of Service and Payment Policy.
2. Payment Terms
2.1. Payment Obligation
Subscribers agree to pay all fees or charges to their account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. All payment obligations are non-cancelable and fees paid are non-refundable, except as expressly provided in Section 4 of these Terms.
2.2. Payment Processing
a) All payments are processed through Stripe, our third-party payment processor.
b) Subscribers must provide current, complete, and accurate billing and credit card information.
c) Subscribers agree to pay all costs of collection, including attorney's fees and costs, on any outstanding balance.
d) In the event any amount is not paid in full when due, we reserve the right to suspend or terminate Subscriber's access to the Service immediately and without notice.
2.3. Automatic Renewal
Unless Subscriber provides adequate notice of cancellation before the end of the applicable subscription period, their subscription will automatically renew and they authorize us to collect the then-applicable subscription fee and any taxes through our payment processor.
3. Trial Terms

Trial offers are subject to these Terms and may be modified or canceled at any time without notice.

Trial periods begin on the date of initial subscription and end as specified in the trial offer.

Subscribers will be automatically charged the applicable subscription fee at the end of the trial period unless they cancel before the trial expires.
4. Refund Policy
4.1. Refund Eligibility
a) New Subscribers: First-time subscribers who experience issues with the Service must notify us promptly after their initial payment. All refund decisions remain at our sole discretion, considering factors such as usage, timing of the request, and the nature of the issue.
b) Renewal Payments: Subscription renewals are final and non-refundable. No refunds will be issued for renewal payments under any circumstances.
c) Trial Conversions: Subscribers who have used a free trial are generally not eligible for refunds, as the trial period provided sufficient opportunity to evaluate the Service. Any exception to this policy requires extraordinary circumstances and remains entirely at our sole discretion. Refund requests from trial users may be denied for any reason or no reason at all.
4.2. Refund Conditions
Refunds will only be considered if ALL of the following conditions are met:
a) The refund request is submitted promptly after the issue arises or payment is made
b) The Subscriber has not violated our Terms of Service or Acceptable Use Policy
c) The account has not been flagged for fraudulent or suspicious activity
d) The Subscriber provides a valid reason for the refund request
e) The Service has not been extensively used (usage limits apply at our discretion)
4.3. Refund Process
a) All refund requests must be submitted in writing to [email protected] with the subject line "Refund Request"
b) Refund requests must include the account email, transaction ID, and detailed reason for the request
c) We will review refund requests at our convenience and respond when possible
d) All refund decisions are made at our sole and absolute discretion and are final
e) If approved, refunds will be processed through Stripe
f) Refunds will be issued to the original payment method only
4.4. Non-Refundable Items
The following are explicitly non-refundable:
a) Any payments where the refund request was not made promptly
b) Subscription renewals
c) Partial month or partial billing period charges
d) Any add-on services or one-time fees
e) Accounts terminated for Terms of Service violations
5. Disclaimer of Warranties
THE SERVICE AND ALL RELATED COMPONENTS AND INFORMATION ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO:
a) WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
b) WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, SECURITY, OR RELIABILITY OF THE SERVICE
c) WARRANTIES REGARDING THE SATISFACTION OF ANY GOVERNMENT REGULATIONS OR STANDARDS
This disclaimer of warranties applies to all users, including paid Subscribers.
6. Payment Processing and Security
6.1. Stripe Integration
We use Stripe for payment processing. By providing payment information, you acknowledge and agree that:
a) Your payment information is transmitted directly to Stripe via encrypted channels
b) We do not store complete credit card numbers on our servers
c) Stripe's terms of service and privacy policy apply to payment processing
d) We are not responsible for Stripe's handling of your payment information
6.2. Disputes and Chargebacks
a) Initiating a chargeback or payment dispute without first contacting us may result in immediate account termination
b) We reserve the right to dispute any chargebacks and provide evidence of service delivery
c) Accounts with successful chargebacks will be permanently banned from the Service
7. Price Changes
We reserve the right to change our pricing at any time. Price changes will:
a) Be communicated to Subscribers at least thirty (30) days in advance
b) Take effect at the next renewal period for existing Subscribers
c) Not affect the current billing period
8. Modifications to Terms

We reserve the right to modify these Terms at any time with thirty (30) days notice for material changes affecting payment terms.

Continued use of the Service following any modifications to these Terms constitutes acceptance of those modifications.
9. Limitation of Liability
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS ACTUALLY PAID BY YOU IN THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY, OR, IF GREATER, ONE HUNDRED US DOLLARS ($100). The full limitation of liability is described in our Terms of Service.
